This policy explains how to ask Keenfunnel LLC ("Keenfunnel", "we", "us") to remove content from our sites, social media channels and other platforms, and how we handle those requests. It covers copyright notices under the US Digital Millennium Copyright Act ("DMCA") and every other removal request.
Where to send requests
Send every request to our designated agent:
- Copyright Agent, Keenfunnel LLC
- 418 Broadway STE 4000, Albany, NY 12207, United States
- Email: legal@keenfunnel.com
- Phone: +1 888-884-7009
Copyright notices
If you believe that material available through our sites or services infringes your copyright, send us a written notice that includes:
- Your physical or electronic signature, as the copyright owner or a person authorized to act for them (typing your full name is enough);
- Identification of the copyrighted work, or a representative list if several works are involved;
- Identification of the infringing material and enough information for us to find it, such as its URL;
- Your name, address, telephone number and email address;
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.
If you are not sure whether the material infringes your rights, consider asking a lawyer first. Under the DMCA, anyone who knowingly makes a false claim may be liable for damages.
What we do with a notice
- We acknowledge your notice within 5 business days.
- If the notice is complete, we remove or disable access to the material expeditiously and tell the person who posted it, where we can reach them.
- If the notice is incomplete, we tell you what is missing.
Counter-notices
If your material was removed and you believe this was a mistake or a misidentification, you can send a counter-notice to our designated agent that includes:
- Your physical or electronic signature;
- Identification of the material that was removed and where it appeared before removal;
- A statement under penalty of perjury that you believe in good faith that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, of any judicial district in which Keenfunnel may be found, and that you will accept service of process from the person who sent the original notice or their agent.
We send a copy of your counter-notice to the person who sent the original notice. Unless they tell us that they have filed a court action to stop the infringement, we restore the material 10 to 14 business days after we receive your counter-notice.
Repeat infringers
In appropriate circumstances, we end the accounts and services of users who repeatedly infringe copyright.
Other removal requests
You can also ask us to remove content that:
- Infringes a trademark or another intellectual property right;
- Is defamatory;
- Is otherwise unlawful, or breaches our Acceptable Use Policy.
Tell us who you are and how to contact you, where the content is (for example its URL), why it should be removed, and any evidence you have, such as a court order or a trademark registration. We decide within 10 business days and tell you the outcome. If we need more information, we ask you for it.
Personal data
If your request concerns personal data about you, we handle it as a data protection request under our Privacy Policy and reply within one month.
Good faith
We handle every request in good faith and apply this policy consistently. It does not limit any other remedy available to us or to you.
